1. Parties and acceptance

This document constitutes the General Terms and Conditions (“Terms and Conditions”) governing any purchase made through the website www.rexhagold.com (the “Website”), operated by:

REXHA GOLD SH.P.K., a limited liability company, duly registered with the National Business Center (NBC) under NUIS K92702205O, with its registered office at: “Dyli Haxhire Myzyri” Neighborhood, “Aqif Pasha” Blvd., Building no.10/1, Floor 11, Apt.44, Elbasan, Albania (hereinafter referred to as the “Company”, “We”, “Us”),

and

Any natural person over the age of 18, acting exclusively within the framework of their personal needs, who visits the Website www.rexhagold.com and/or makes a purchase from Rexha Gold Sh.p.k. (hereinafter “You”, the “Customer”, the “Buyer”).

Please read these Terms and Conditions carefully before using the Website and/or placing any order, as they directly affect your rights and obligations. Use of the Website and/or placing an order constitutes full and unconditional acknowledgement and acceptance of these Terms and Conditions. If you do not agree with any of these provisions, you may not use the Website and/or place any order.

These Terms and Conditions have been drawn up in accordance with Albanian Law No. 10128/2009 “On Electronic Commerce” and Law No. 9902/2008 “On Consumer Protection”.

2. Prices and payment

2.1 Prices

All product prices displayed on the Website are expressed in Euros (€), inclusive of all applicable taxes. The Company reserves the right to modify prices at any time and without prior notice. Products will be invoiced on the basis of the prices in force at the time your order is registered.

Prices displayed in the shopping cart always reflect the most recent price shown on the product description page. Adding a product to your cart does not guarantee that its price will remain unchanged.

2.2 Pricing errors

Although the Company makes every reasonable effort to avoid errors, information and prices displayed on the Website may contain technical or typographical mistakes. The Company will not honour orders resulting from incorrect information or pricing. Should the displayed price be lower than the actual price of the product, the Company will contact you by email to either cancel the order or provide instructions on how to pay the difference.

2.3 Shipping costs

Shipping costs are calculated and clearly displayed during the purchase process, prior to final order confirmation. The Customer expressly accepts the shipping costs before finalising the order.

2.4 Payment methods

You may pay for your order using the following methods:

  • (I) By credit/debit card (Visa, MasterCard and other accepted cards): the order amount is debited immediately upon confirmation. The order registration date is the date of online payment.
  • (II) By bank transfer — the Website provides you with the Company's bank details. The transfer must be completed within 7 (seven) working days of the order date. The order registration date is the date the funds are received in the Company's account. Orders for which payment is not received within this period are automatically cancelled.
  • (III) By PayPal — payment is processed through the PayPal platform upon order confirmation. The order registration date is the date PayPal confirms the payment.

2.5 Payment security

All online transactions are processed through secure, encrypted platforms. The Company does not store and has no access to your bank card details.

2.6 Invoice

An invoice for your order is issued upon dispatch and may be requested at any time by emailing sales@rexhagold.com.

3. Order, products and delivery

3.1 Conditions for placing an order

By placing an order, you confirm that:

  • You are at least 18 years of age and have full legal capacity to place and honour any order;
  • You are acting within the framework of your personal needs and not for commercial or professional purposes.

3.2 Order process

Orders are placed exclusively through the Website following these steps:

  1. Step 1: Select the desired product and add it to your shopping cart.
  2. Step 2: Review your cart by clicking the “Cart” tab and apply any discount code if available.
  3. Step 3: Click “Proceed to Checkout” to continue with finalising your order.
  4. Step 4: Enter the required details: your first and last name; contact details (phone and email); exact billing address; chosen delivery method; exact delivery address; payment method. At this stage you will also be asked to read and accept these Terms and Conditions, including the restrictive conditions set out in Section 4.6.
  5. Step 5: Review the order summary, correct any errors and click “Confirm Order”.
  6. Step 6: Complete payment using your chosen method.

3.3 Order confirmation

The Company is bound by the order only upon receipt of our electronic confirmation and receipt of the corresponding funds in the Company's account. The Company reserves the right to cancel or refuse, without liability, any order from a Customer for reasonable cause, particularly where there is doubt or dispute regarding a previous order.

Once your order has been registered, you will receive a confirmation email with your order details. This confirmation email does not constitute acceptance of the order by the Company, but merely acknowledgement of receipt.

3.4 Order changes — unavailable products

Our offers and prices are valid within the limits of available stock. Should a product ordered through the Website prove unavailable following order confirmation, the Company will notify the Customer immediately by phone or email, with the following information:

  • (I) The estimated availability and delivery timeframe;
  • (II) The final price, which may differ from the price paid due to fluctuations in precious metal, gemstone or other production costs. Any price difference will be communicated to the Customer prior to final confirmation and must be settled before delivery;
  • (III) The option to: (a) proceed with the order at the new timeframe and/or price; (b) exchange for another item in our boutique; (c) retain the payment as store credit valid for 12 months; or (d) receive a full monetary refund of the amount paid through the Website.

The Company reserves the right to cancel the order if the Customer is unreachable or fails to confirm acceptance of the new terms within 7 (seven) working days of notification. In this case, the payment made will be retained as store credit available to the Customer for 12 (twelve) months.

Please note: Orders for out-of-stock products are not processed through the Website. They are negotiated exclusively via WhatsApp, with payment made in person at the boutique or by bank transfer.

3.5 Delivery

3.5.1 Delivery areas: The Company delivers within Albania and Kosovo via DHL.

3.5.2 Delivery times: Products are dispatched within 3–7 (three to seven) working days from the date of order registration and payment receipt. The Company will notify you in the event of an unforeseen delay.

3.5.3 Delays: We invite you to regularly track your order using the tracking number provided by DHL. The Company will inform you of any shipping delay as soon as it becomes aware of one. Should you place multiple orders simultaneously and only some are delayed, the Company may split the shipments.

3.5.4 Damaged parcel: Should the parcel appear damaged or tampered with upon delivery, you must refuse it from the carrier and notify us immediately at sales@rexhagold.com, attaching: a written statement confirming receipt of the damaged product; a copy of your identity document; photographs of the damaged parcel.

3.5.5 Transfer of ownership and risk: Ownership and risk of the products transfer to the Customer upon physical delivery. Should the parcel be returned to the Company due to an incorrect address, or should you fail to collect it within the period specified by DHL, the Company will notify you immediately. If, after 30 (thirty) calendar days from notification, the Customer does not respond to the Company's communications, the Company retains ownership of the product and the payments made.

3.6 Product descriptions

The Company makes every reasonable effort to ensure the online catalogue is as accurate and complete as possible. Product photographs are for illustrative purposes only. Colours may vary depending on your screen settings. Please refer to the description of each product for exact specifications. If in doubt, contact the Company at sales@rexhagold.com.

4. Returns, right of withdrawal and refunds

4.1 Returns policy — exchange in lieu of monetary refund

The Customer has the right to return a product purchased through the Website within the statutory period, subject to the procedure and conditions set out in this section. The Company does not offer monetary refunds. The only available solution is the exchange of the product for another item at the Rexha Gold physical boutique, in accordance with the conditions set out in this section.

4.2 Right of withdrawal — 14 days

In accordance with Article 37 of Law No. 9902/2008, the Customer has the right to withdraw from the contract within 14 (fourteen) calendar days of physical delivery of the product, without penalty and without giving any reason.

The Company does not offer monetary refunds. The exclusive solution available is the exchange of the product in accordance with the conditions set out in this section.

Exchanges are carried out exclusively at the Rexha Gold physical boutique, under the following conditions:

  • (I) Exchange for a product of equal value: no monetary difference is returned.
  • (II) Exchange for a product of higher value: the price difference is paid by the Customer at the time of exchange.
  • (III) Exchange for a product of lower value: the price difference is treated as store credit, valid for use within 12 (twelve) months of the exchange date.

4.3 Exclusions — products not eligible for return

The right of return and exchange does not apply to:

  • (I) Personalised or made-to-order products: engravings, specific sizes, custom colour combinations or any modification requested by the Customer;
  • (II) Earrings and hygiene-sensitive products: earrings and any other product with direct hygienic contact, removed from their original packaging;
  • (III) Products damaged after delivery: products damaged as a result of improper use, accidents, negligence or third-party intervention.

4.4 Return acceptance conditions

A return is accepted and an exchange carried out only if:

  • The return procedure described by the Company has been fully followed;
  • The product is returned in perfect condition, unworn and unsoiled;
  • The Company's specialists confirm that the setting and stone are consistent with the original product;
  • The product is returned with its complete original packaging.

Return procedure: the Customer notifies the Company by email at sales@rexhagold.com within the 14-day period; awaits written confirmation; attends the boutique in person; selects the replacement product. Return shipping costs are borne by the Customer.

4.5 Defective products

Should the Customer identify a defect within 14 (fourteen) calendar days of delivery, the Company offers:

  • Repair of the product at no cost, within 30 (thirty) calendar days; OR
  • Exchange in accordance with the conditions of this section.

The assessment of the defect is carried out exclusively by Rexha Gold Sh.p.k. specialists. Price reduction and monetary refund are not available as long as the Company offers repair or exchange within the applicable timeframes. In the event of a confirmed defect, return shipping costs are covered by the Company.

4.6 Restrictive conditions — summary of obligations

The Customer acknowledges and expressly accepts the following conditions, which have been drawn up in accordance with Albanian legislation:

  • NO MONETARY REFUND: The Company does not offer monetary refunds. The exclusive solution is an exchange in accordance with Section 4.2;
  • NO RETURN FOR EARRINGS AND HYGIENE-SENSITIVE PRODUCTS: in accordance with Section 4.3 (II);
  • NO RETURN FOR PERSONALISED PRODUCTS: in accordance with Section 4.3 (I);
  • EXCLUSIVE SOLUTION IN THE EVENT OF A DEFECT: repair or exchange in accordance with Section 4.5.

These conditions have been set out in accordance with applicable Albanian legislation and have been communicated to the Customer in a clear, prominent and distinct manner within this document, prior to the finalisation of any order. Acceptance of the Terms and Conditions via the checkbox on the checkout page constitutes full electronic proof of the Customer's express and individual acknowledgement and acceptance of these restrictive conditions, within the meaning of Article 686 of the Civil Code of the Republic of Albania.

5. Warranties

5.1 Brand warranties

Certain products sold through www.rexhagold.com, such as watches and items from specific brands, may be accompanied by a warranty issued directly by the manufacturer or the respective brand. The terms, duration and scope of such warranties are determined exclusively by each brand's policy, and Rexha Gold Sh.p.k. accepts no responsibility for their enforcement.

5.2 Rexha Gold warranty policy

Products sold through www.rexhagold.com are luxury items crafted from precious metals and gemstones. Rexha Gold Sh.p.k. does not offer a warranty for normal wear and tear resulting from everyday use of the products, including:

  • Scratches and aesthetic changes from regular contact;
  • Gradual fading of the surface, plating or rhodium finish over time;
  • Mechanical damage from impacts, drops or pressure;
  • Chemical damage from contact with water, perfume, chemicals or corrosive substances;
  • Loss or cracking of stones as a result of external impact;
  • Third-party interventions after delivery.

5.3 Protection against defects within 14 days

Should the Customer identify a technically verifiable defect — not resulting from use, negligence or misuse — within 14 (fourteen) calendar days of delivery, the Company offers as its exclusive solution:

  • (I) Repair of the product at no cost to the Customer, within 30 (thirty) calendar days of the defect being confirmed; OR
  • (II) Exchange or rectification of the product in accordance with the conditions set out in Section 4.

The assessment of the defect is carried out exclusively by Rexha Gold Sh.p.k. specialists, whose decision is final. Price reduction and monetary refund are not available as solutions.

5.4 The nature of precious products

The Customer acknowledges that jewellery and watches crafted from precious metals, gemstones and delicate materials are luxury products requiring special care and periodic professional maintenance. Damage, deformation and destruction of products, as well as the cracking and loss of stones, pearls or other components as a result of external impact, knocks, misuse or negligence, do not constitute a defect and are not covered by any warranty of the Company.

6. Liability

The Company shall not be liable for:

  • (I) Damage caused by the Customer's own action, omission or fault;
  • (II) Damage caused by force majeure circumstances (natural disasters, acts of authorities, conflicts, strikes, etc.);
  • (III) The Customer's failure to follow care and maintenance instructions;
  • (IV) Damage to the product following transfer of ownership and risk in accordance with Section 3.5.5.

The Company's total liability is limited to the amount paid for the relevant order. Product photographs are for illustrative purposes only. The Website may contain links to third-party websites for which the Company accepts no responsibility.

7. Intellectual property

The Website and all its elements — including products, documents, images, texts, logos and any other visual or audio content (“the Content”) — are protected by applicable laws on trademarks, copyright and intellectual property, and belong to or are licensed to the Company.

  • (I) You may access and display the Content solely for private, non-commercial use;
  • (II) No element of the Website may be copied, reproduced, modified, distributed or used in any way without the prior written consent of the Company;
  • (III) Any hyperlink to the Website using framing or in-line linking techniques is strictly prohibited.

8. Personal data

The Company processes your personal data (name, address, email, phone, payment details) exclusively for the purposes of order fulfilment and customer communication, in accordance with Law No. 124/2024 "On the Protection of Personal Data" of the Republic of Albania, which is fully aligned with the General Data Protection Regulation (GDPR) of the European Union.

9. Marketing communications

The Company may send you commercial offers by email or message, only with your prior and express consent, in accordance with Article 9 of Law No. 10128/2009. You have the right to object to such communications at any time, at no cost, by clicking the “unsubscribe” link included in every email.

10. Complaints and dispute resolution

10.1 Complaints: Any complaint regarding the quality of products or service must be submitted in writing within 7 (seven) working days of delivery, by email to sales@rexhagold.com, specifying the order number and the nature of the complaint. Failure to submit a complaint within this period is deemed acceptance of the product in the condition delivered.

10.2 Dispute resolution: These Terms and Conditions are governed by Albanian law. Any dispute shall first be resolved through mutual agreement between the parties. In the absence of a resolution within 30 (thirty) days, the dispute shall be subject to the jurisdiction of the competent courts of Tirana, Albania, in accordance with Article 24 of Law No. 10128/2009.

11. Miscellaneous

11.1 Severability: Should any provision of these Terms and Conditions be deemed unlawful, invalid or unenforceable, that provision shall be considered severable and shall not affect the validity of the remaining provisions.

11.2 Non-waiver: The Company's failure to exercise any right under these Terms and Conditions shall not be construed as a waiver of that right.

11.3 Transfer of rights and obligations: The Company may transfer its rights and obligations under these Terms and Conditions to any affiliated entity. The Customer may not transfer without the Company's prior written consent.

11.4 Amendments: The Company reserves the right to modify these Terms and Conditions at any time. The updated Terms and Conditions will be published on the Website and will apply only to orders placed after the date of modification.

11.5 Order of precedence: In the event of any inconsistency between these Terms and Conditions and any verbal notice or informal communication, these Terms and Conditions shall prevail.

By placing an order on www.rexhagold.com, the Customer declares that they have read, understood and fully and unconditionally accepted these General Terms and Conditions of Online Sale of Rexha Gold Sh.p.k.
